If you have created an LLC in New Mexico from Spain or any other country, one of the first steps you must take is to apply for an EIN (Employer Identification Number).

This number is like a "social security number" for your company, necessary to open a bank account, hire employees or file taxes in the United States.

Here's how to get it easily.

Step 1: Have the LLC registered

Before applying for an EIN, you must have set up your LLC in New Mexico. If you have already completed this step, you have the LLC formation documents ready, such as the Certificate of Organization.

There are three main ways to obtain your EIN:

  2. For your Registered AgentThis is the most reliable option if you are not a U.S. resident, as they will take care of the whole process and deliver the number to you. EIN without long waits.
  3. By mail or faxThis is the option you will have to choose if you are not a US resident and do not have a SSN or ITIN. You will have to do it in person and cross your fingers that the fax or letter arrives with the application.

If you choose option 1 or 3, you can skip directly to step 5.

Step 3: Complete the SS-4 form

To apply for the EIN in person, you need to download and fill out the form SS-4. Here I explain you how to do it in a simple way, but you can also take a look at the IRS instructions for completing Form SS-4:

  • Name of LLCEnter the legal name of your LLC as it appears in the formation documents.
  • Type of entityCheck the box corresponding to "Limited Liability Company" (LLC).
  • Number of LLC membersIf your LLC is a sole proprietorship, select "1".
  • Mailing addressYou must use a U.S. address. If you have hired a registered agent, such as Northwest Registered Agentyou can use their address.
  • Reason for requestSelect "Start a new business".
  • SignatureAt the end of the form, be sure to sign it as "Managing Member" of your LLC.

Step 4: Submit the form

If you cannot apply for the EIN online, you must fax or mail Form SS-4 to the IRS.

  • FaxSend the completed form to corresponding IRS fax number. If you choose this option, you should receive your EIN in about 4 to 7 business days.
    • To send the fax from outside the U.S., you must send it to +1 304-707-9471.
    • My recommendation is that you hire a virtual fax number in the USA both to send the SS-4 form and to receive the IRS response.
  • MailIf you prefer to send it by mail, it will take longer, between 4 and 6 weeks to receive a response. The address to send the form can be found on the official IRS website.

Step 5: Receive EIN

If you chose to apply for the EIN with a Registered Agent, they will provide you with your number as soon as they receive it.

But if you chose to apply for it yourself, the process will be can take quite a long time and it is not clear by what means they will respond to you, since do not follow a criterion real.
